These terms and conditions, as amended from time to time, govern CHAT2OZ, Stable Research and their affiliates respective rights and obligations to you ‘the user’ with regard to your access to CHAT2OZ.

 

Users of CHAT2OZ that are active members of the Stable Research Panel and have already agreed to the terms and conditions set out in http://www.stableresearch.com.au/terms-conditions/

 

By accessing CHAT2OZ, downloading the application or using CHAT2OZ, you accept these terms and conditions as follows:

CHAT2OZ reserves the right to unilaterally change the terms and conditions (including without limitation, with the addition of new terms and conditions and/or guidelines). When these changes are made, CHAT2OZ will make a copy of the amended terms and conditions available at the following website: http://www.mdi-global.com/#!chat2oz/z49gr

 

It is the user’s responsibility to check these terms and conditions regularly for any updates and changes. Continued use of CHAT2OZ will indicate acceptance of any changes to these Terms and Conditions.

 

REGISTRATION
  1. CHAT2OZ users who are 18 years and younger must get the consent of their parents/guardians to register and use CHAT2OZ.
  2. It is the users responsibility to ensure that they are enabled to access CHAT2OZ, with regard to applicable software, hardware (compatible cellular telephone) or otherwise.
  3. It is the users obligation to make sure that they have access to the internet. CHAT2OZ will not provide payment for any internet or phone service provider.  
  4. The user confirms the Registration Information they have provided is accurate and that they agree to (a) provide accurate, current and complete information as may be prompted by any registration forms or surveys conducted within the CHAT2OZ (b) maintain the security of your password; and (c) maintain and promptly update your registration information and any other information you provide to CHAT2OZ, so as to keep it accurate, current and complete. Registration requires information that includes without limitation full legal name, date of birth, postcode of your primary residence, mobile cellular phone number and functioning email address.
  5. If the username has not been active for a period of atleast one year, CHAT2OZ may terminate the user account without notice.
  6. Only the user may use CHAT2OZ under their username and password.
  7. The user shall be responsible for the security of their password, mobile cellular telephone and for any and all activities which may occur under their username and password. The user hereby indemnifies CHAT2OZ  from any loss or damage resulting from any activity under their username and password.
  8. The user may have only one active CHAT2OZ account at any time. Only one account per mobile phone number is allowed. If accessing CHAT2OZ via more than one device please use your main or primary mobile cellular phone number when logging in. Multiple accounts for any user is subject to termination and forfeiture of all incentives and rewards.
  9. The user agrees not to use or attempt to use another user`s username and password to access CHAT2OZ or to create a false identity.
  10. The user is obliged to inform CHAT2OZ immediately of any unauthorised use of their username and password, or any other breach of security by contacting the customer care department at research@mdindaba.com.

 

SHARING INFORMATION
  1. CHAT2OZ grants the user a non-exclusive, non-transferable, revocable, personal license to download and install the CHAT2OZ application for the purpose of using CHAT2OZ on their mobile cellular telephone.
  2. By joining CHAT2OZ the user agrees to participate in market research such as completing surveys, chat discussions, ideas, feedback, or other information or content. This may include going into stores or to other locations to fill out mobile surveys whilst in store. By joining Chat2Oz, the user agrees to provide their views and opinions as a market research respondent. 
  3. The users participation in market research via the Chat2Oz application does not create any relationship of partnership, employee and employer, agency, principal and contractor with Mobile Digital Indaba Pty Ltd, X&Go, Stable Research or any of their affiliates.
  4. CHAT2OZ will provide incentives as a thank you for the users participation in certain market research projects upon validation of their research tasks.   
  5. The user may provide information to CHAT2OZ via their participation in market research, including survey responses, chat discussions, ideas, feedback, or other information or content ("User Content"). Any User Content produced by the user grants CHAT20Z and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content throughout the world in any media, without acknowledgement or compensation to the user.
  6. Unless explicitly stated in these terms and conditions, nothing in these terms and conditions shall be construed as conferring to the user any license or other right to intellectual property rights. The user may not use, copy or imitate, in whole or in part, our copyright, trademarks, domain names or other intellectual property.
  7. Information and content made available to the user in CHAT2OZ may contain trade secrets or other confidential or proprietary information of CHAT2OZ’S clients. The user must hold in strict confidence and not disclose to any other person any information and content that they access or learn in connection with their participation in any survey, project, questionnaire, or other market research activity related to the Services. The user must not use any such information or content for any purpose other than their participation in market research in accordance with this Agreement.
  8. The user hereby agrees to notify Chat2Oz immediately if they learn of or suspect any use or disclosure of, or access to, any such information or content other than as specifically authorised in this Agreement.

 

Chat2Oz USAGE GUIDELINES
  1. The user may use CHAT2OZ for personal, non-commercial and lawful use only.
  2. The user is not allowed to use CHAT2OZ to engage in any behaviour deemed, within our sole discretion, to be inappropriate, undesirable or illegal.
  3. The User Content must comply with any guidelines provided by CHAT2OZ.  
  4. The user is not allowed to make publicly available personal information of a third party.
  5. The user represents, warrants and agrees that nothing posted, transmitted or shared by them on CHAT2OZ will violate or infringe upon the rights of a third party.
  6. CHAT2OZ may be unavailable from time to time (inter alia due to the interruption of services/coverage by the cellular networks, for maintenance or to change the features and technical aspects of the CHAT2OZ application) and we do not provide a warranty as to the availability thereof.
  7. The user cannot rely on the CHAT2OZ services to dispatch emergency communications.
  8. The user hereby gives CHAT2OZ consent to monitor their activity on CHAT2OZ.  

 

 

PRIVACY

CHAT2OZ and their affiliates endorses and complies with the Australian Privacy Principles (APPs) in the Privacy Act (1988) in relation to the handling of personal information. They also comply with the Market and Social Research Privacy Code (2014) which sets out how the APP’s are to be applied in relation to the collection, retention, use and disclosure of personal information in market and social research. This code is administered by AMSRO (Australian Market and Social Research Organisation) and adjudicated by the Australian Privacy Commissioner.To see their Privacy Policy in full go to: http://www.stableresearch.com.au/privacy-policy/.

 

  1. The user agrees that CHAT2OZ may collect personal information about you and may use this information to render services to you such as activating the CHAT2OZ application, improve the services they provide, compile market research and other usage statistics.
  2. CHAT2OZ does not provide secure communication over the internet and CHAT2OZ will not be responsible for unauthorised access to the users communications.
  3. CHAT2OZ will take reasonable care to protect the users privacy, but cannot guarantee their privacy. The user agrees not to post personal information on CHAT2OZ so that it is publicly accessible to other users. CHAT2OZ is not responsible for any harm the user  may suffer if you fail to comply with this undertaking.
  4. CHAT2OZ will only use the users personal information (such as your name, email address, phone number, and other information that specifically identifies you) for the following purposes (unless the user specifically consents otherwise):
    1. CHAT2OZ to directly contact the user regarding mobile phone research or to verify that they have only one CHAT2OZ account;
    2. To respond to any queries that the user have sent to us via email or in the chat functionality in CHAT2OZ;
    3. To fulfil any incentive or reward which the user has earned through the conduct of market research;
    4. If required to release personal information because of a court order, government agency, or by law.
  5. The users personal information, including location data and images, will always be collected with their consent and only by lawful and fair means.
  6. The user agrees that CHAT2OZ may collect sensitive information from you e.g. political opinion, health information etc.  Sensitive information will only be collected if it is directly related to the research you are taking part of. 
  7. CHAT2OZ will not sell the users personal information to any third party.
  8. The users personal information and data will be stored and housed in Australia. However, CHAT2OZ may transfer or store the users personal information in locations around the world, including in the Cloud for market research analysis. Wherever the users personal information, collected with their consent, is stored, transferred, or processed by CHAT2OZ, we will take reasonable steps to safeguard the privacy of their personal information. When using or disclosing personal information transferred from Australia, CHAT2OZ will commit to maintaining a level of protection for the users personal data that is equivalent to the protection offered under Australian Privacy Principles.
  9. The user can request access to their personal information or that their personal information be destroyed, deleted or de-identified, by sending a written request to research@mdindaba.com.

 

INDEMNITY
  1. The user agrees that CHAT2OZ, Mobile Digital Indaba Pty Ltd , X&Go, Stable Research or any of their affiliates shall not be liable for any direct, indirect, special, incidental or consequential damages or loss of any kind resulting from their usage of CHAT2OZ, the CHAT2OZ application, content acquired from CHAT2OZ or any third party and/or as a result of their inability to access/use CHAT2OZ and/or as a result of any termination of their usage by us.
  2. The user furthermore indemnifies CHAT2OZ against any damages, liability, claims or demand by third parties or loss as may be suffered by us arising from their access to and/or usage of CHAT2OZ and/or their breach of these terms and conditions.

 

TERMINATION
  1. CHAT2OZ reserves the right to terminate CHAT2OZ at any time. CHAT2OZ further reserves the right to terminate/suspend access and/or usage of CHAT2OZ at any time without notice and will not be obliged to give any reason for such termination/suspension.
  2. Upon termination/suspension, the users license referred to in clause 2 terminates/suspends at the same time and the user must immediately stop using the CHAT2OZ application, remove it from their cellular telephone and destroy copies thereof.
  3. If the user is in breach of these terms and conditions, CHAT2OZ may, without prejudice to any other rights it may have under common law, terminate and/or suspend their access and/or use of CHAT2OZ immediately without prior notice to you.
  4. All legal notices to CHAT2OZ must be sent to CHAT2OZ at research@mdindaba.com marked for the attention of the legal department.
  5. The user agrees that publishing a notice on our website (http://www.mdi-global.com/#!chat2oz/z49gr) or sending them a notice via CHAT2OZ shall constitute sufficient notice.

 

JURISDICTION
  1. These terms and conditions shall be governed by and construed and interpreted in accordance with the laws of the Privacy Act 1988.
  2. These terms and conditions constitute the whole of the agreement between CHAT2OZ and ‘The User’ and no undertaking, representation, term or condition relating to the subject matter of this agreement not incorporated in these terms shall be binding on any of the parties.
  3. No variation, addition, deletion, or agreed cancellation of these terms and conditions will be of any force or effect unless effected by CHAT20Z.
  4. Failure or delay on the part of CHAT2OZ in exercising any right, power or privilege hereunder will not constitute or be deemed to be a waiver thereof or any other right hereunder, nor will any single or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other right, power or privilege. A waiver by CHAT2OZ shall not be effective unless it is expressly stated in writing. A waiver in respect of one breach will not be considered a waiver in respect of any other or subsequent breach.
  5. Any provision in these terms and conditions which is or may become illegal, invalid or unenforceable shall be ineffective to the extent of such prohibition or unenforceability and shall be treated as if it were not written and severed from these terms and conditions, without invalidating the remaining provisions of these terms and conditions.
